We need your help. See below and advise us of your experience. We intend to take action shortly. Replies will be kept confidential .

TELSTRA SICK LEAVE - GENERAL

Telstra appears to have initiated a concerted campaign to target those who have the misfortune to be sick. Sick Leave is a work place right. There are a number of different attacks. We list some below. These are serious breaches of the Fair Work Act. The Act says (inter alia):
A person must not take adverse action against another person
(a) because the other person has a workplace right or
(b) to prevent the exercise of a workplace right by the other person..
Adverse action is taken if the employer injures the employee in his or her employment;. or alters the position of the employee to the employee's prejudice

TELSTRA SICK LEAVE - ATTACK #1

Telstra has introduced "Forced Overtime". Leaving aside that problem, Telstra say that if you are rostered for overtime, and you are unable to attend "we (Telstra) are within our rights to ask for a (retrospective) medical certificate." The EBA gives you 5 days per year without a certificate. Now you will be punished if you exercise the right.

TELSTRA SICK LEAVE - ATTACK #2

Performance Plan - Telstra is asking you, in order to get the usual bonus, to supply a certificate for all sick leave. The EBA gives you 5 days per year without a certificate. Now you will be punished if you exercise this right.

TELSTRA SICK LEAVE - ATTACK #3

The new Telstra Rules state:
If you have taken any sick days with in the week whether it has a certificate or not you won't be considered for Overtime
If you have over 4 weeks of annual leave you won't be considered until you have booked some to get under the 4 weeks
