This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement is not required. Increases made under previous National Wage Case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments. EMPLOYEES COVERED BY FORMER PAID RATES AWARD C.1.1 The provisions of this Schedule only apply to an Australia Post employee who was employed in Australia Post immediately prior to 20 January 2000 - an "eligible employee". C.1.2 The following provisions of this schedule set out the pay rates which applied under the former paid rates award which exceed the award minimum rate in Schedule A and the associated conditions which determined the appropriate pay point for employees. By applying these provisions to eligible employees, the award pay rate which applied to an employee immediately prior to 20 January 2000 can be determined. Where the award salary rate determined in accordance with this Schedule is higher than that otherwise applying under the general award provisions, it will apply to an eligible employee where the rate remains beneficial to the employee. C.3.1 Frequency of Increments
C.3.2 Promotion and Higher Duties Allowance C.3.2.1 The salary to be paid to an employee on promotion or transfer is normally the minimum rate for that position except that in circumstances involving overlapping salary ranges, the new salary is normally the next highest salary point in the salary range for the new position. C.3.2.2 An employee who was promoted will have included for the purpose of calculating the increment date, any previous period during which the employee acted at the new classification (or a higher classification). This applies whether or not the employee was on higher duties at the new level at the time of promotion provided that: C.3.3 Deferral of Increments C.3.3.1 Where Australia Post is of the opinion that the employee should not immediately receive an increment otherwise payable having regard to the conduct, diligence, efficiency or attendance for duty of the employee, Australia Post may direct that an increment not be paid for a specified period, not exceeding six months.
C.3.3.2 Where an increment has been deferred, Australia Post may determine that, for the purposes of future advancement, the increment shall be deemed to have been granted from the original date of incremental advancement. Provided that
C.3.4 Trained Employees
C.3.4.1 An employee who has resumed permanent employment with Australia Post in one of the following classifications in which the employee is trained can be re-engaged within the relevant salary range:
C.3.5 Higher Duties Allowance C.3.5.1 An employee who had been paid a higher duties allowance was eligible for the same incremental advancement as applied to an employee promoted to the level. |
