Index to Rules


30 - TRANSITIONAL RULE

This Rule shall prevail over any conflicting provisions in any other Rule and the provision of the Rules prior to the introduction of this Rule including any of those Rules relating to the Terms of Office or any office holder.

For the purposes of this Rule the date of transition shall be 1 April 2007.

The persons in the Communications Division listed below, notwithstanding alterations to the Rules of the Communications Division which shall have effect on and from 1 April 2007 shall from the date of transition until 31 July 2007 continue to hold the offices listed below together with any offices held under the Rules of the Union:

SCHEDULE

On and from 1 April 2007 the following alterations to the Rules shall take effect:

1. Insert a new Rule 4.9 immediately following current Rule 4.8 as follows:

4.9 Industry Groups
Industry Groups shall mean the Postal Services Industry Group and the Telecommunications and Information Technology Industry Group. The Postal Services Industry Group shall be constituted by members in the Postal Services Industry Sections and the Postal Industry Sections. The Telecommunications and Information Technology Industry Group shall be constituted by members in the Telecommunications and Information Technology Industry Sections, the Lines and General Sections, the Technical Industry Sections and the Operator Industry Sections.

2. Insert a new rule 4.10 immediately following new Rule 4.9 as follows:

4.11 Industry Section
Industry Section shall mean either the Postal Services Industry Section, the Telecommunications and Information Technology Industry Section, the Postal Industry Section, the Lines and General Industry Section, the Technical Industry Section and the Operator Industry Section as constituted by Rules 46, 46A and 46B of the Communications Divisional Rules.

3. Renumber current Rules 4.9 to 4.13 as Rules 4.11 to 4.15.

4. Delete the word "divisional" appearing before the word "group" in Rule 6.1.3 and insert in lieu thereof the word "industry".

5. Delete current Rule 7.10.7 and insert in lieu thereof the following:

7.10.7 the two (2) Divisional Assistant Secretaries from the Communications Division, and

6. Delete current Rule 7.10.9 and insert in lieu thereof the following:

7.10.8 Provided that on and from 1 August 2007 the following provision shall apply in lieu of Rules 7.10.5, 7.10.6 and 7.10.7 above:

"the remaining members of the Communications Divisional Executive other than the Communications Divisional Vice-Presidents; and"

7. Delete the last paragraph of Rule 7A.1.2 and insert in lieu thereof the following:

"elected from the National Councillors of each Division, Divisional Group or Industry Group as the case may be in accordance with Rule 13A "Election of the National Executive"

8. Delete the word "Divisional" appearing before the word "Group" in Rule 7.15.2.1 and insert in lieu thereof the word "industry".

9. Delete the word "Divisional" appearing before the word "Group" in Rule 7.15.2.2 and insert in lieu thereof the word "industry".

10. Insert the words "or industry" before the word "groups" and insert after the words "groups" the words "as the case may be" in Rule 7A.1.1.

11. Insert a new Rule 7A.1.3 immediately after current Rule 7A.1.2 as follows:

7A.1.3 Provided that on and from 1 August 2007 the following provision shall apply in lieu of Rule 7A.1.2.3 above:
"three National Executive Members comprising two (2) from the Postal Services Industry Group and one (1) Affirmative Action position being elected from eligible female members of National Council; and"

12. Insert a new Rule 7A.1.4 immediately following new Rule 7A.1.3 as follows:

7A.1.4 Provided that on and from 1 August 2007 the following provision shall apply in lieu of Rule 7A.1.2.4. above:
"three (3) National Executive Members comprising two (2) from the Telecommunications and Information Technology Industry Group and one (1) Affirmative Action position elected from eligible female members of National Council."

13. Delete the word "Divisional" appearing before the word "Group" in Rule 7A.4 and insert in lieu thereof the word "Industry".

14. Delete the word "Divisional" appearing before the word "Group" in Rule 7A.5.1 and insert in lieu thereof the word "Industry".

15. Delete the word "Divisional" appearing before the word "Group" in Rule 7A.5.2 and insert in lieu thereof the word "Industry".

16. Delete the word "Divisional" appearing before the word "Group" in Rule 7A.7 and insert in lieu thereof the word "Industry".

17. Delete the word "Divisional" appearing before the word "Group" in Rule 8.6.1 and insert in lieu thereof the word "Industry".

18. Delete the word "Divisional" appearing before the word "Group" in Rule 8.6.2 and insert in lieu thereof the word "Industry".

19. Delete the word "Divisional" appearing before the word "Group" in Rule 10.2 and insert in lieu thereof the word "Industry".

20. Delete current Rule 12.3.2 and insert in lieu thereof the following:

12.3.2 Each candidate for a National Executive office must be nominated by another member of the National Council from his/her own Division.

21. Delete the word "Divisional" appearing before the word "Group" in Rule 13.2.1 and insert in lieu thereof the word "Industry".

22. Delete the word "Divisional" appearing before the word "Sections" in Rule 13.2.2 and insert in lieu thereof the word "Industry".

23. Delete the word "Divisional" appearing before the word "Sections" in Rule 13.3.1 and insert in lieu thereof the word "Industry".

24. Delete the word "Divisional" appearing before the word "Group" in Rule 13.3.2.2 and insert in lieu thereof the word "Industry".

25. Delete the word "Divisional" appearing before the word "Group" in Rule 13A.4 and insert in lieu thereof the word "Industry".

26. Delete the word "Divisional" twice appearing before the word "Group" in Rule 13A.7.1 and insert in lieu thereof the word "Industry".

27. Delete the word "Divisional" appearing before the word "Group" in Rule 15.2.1 and insert in lieu thereof the word "Industry".

28. Delete current Rule 16.1.3.3 and insert in lieu thereof the following:

16.1.3.3 Branch Committee of Management meeting in the case of the Communications Division

29. Delete Rule 16.1.3.4.

30. Delete the word "Divisional" appearing before the word "Group" in Rule 23.1 and insert in lieu thereof the word "Industry".

31. Delete the words "Industrial Relations Act 1988" from Rule 23.1 and insert in lieu thereof the words "Workplace Relations Act 1996".

32. Delete the word "Divisional" 3 times appearing before the word "Group" in Rule 28.2 and insert in lieu thereof the word "Industry".

33. Insert after current Rule 29 a new Rule 30 as follows:
