CWU T&S WEEKLY BULLETIN NO 2021 / 46
7 November 2021

OPTUS FORCED LEAVE

We have rejected the response of Optus. There was no assurance that HR would take measures to fix the problems. We will now take the matter to the FWC. Our response stated:

    I note your assurances that Optus is not forcing employees to take leave.
    Therefore we cannot understand why Optus HR, the management unit responsible for the actions of other units, refuses to issue clarifying directions to other units when there are complaints that the policy is not being followed,
    Indeed, it is more than policy. For example the threat to impose a lower KPI for not taking leave exposes Optus to several actions including:
    - breach of general protections by adverse action
    - breach of general protections by using misleading statements
    - breach of the EBA
    We cannot accept the response.

SE CONSTRUCTION SHIFT DISPUTE

We have completed step 1 of the EBA dispute resolution process without a result. We will now move to step 2. The issues involve shift work = when do you become a shift worker, and can you opt out?

VITA GROUP WORKERS - INVITATION

The Union for Telstra workers, the CEPU, is welcoming new members from across Vita Group employees transitioning across to the Telstra retail business. Telecommunication retail employees are highly skilled technical sales professionals and the CEPU wants to ensure your pay and conditions continue to reflects this.
We are at the early stages of bargaining for a new Enterprise Agreement for workers across the Telstra Group, including the retail business. This will apply to you when certified.
Within the Agreement, Telstra Retail employees have their own section that specifically deals with matters applicable to the operational group.

See Section 11 of the current EBA where you can see

  • Rates of pay;
  • Meal allowance;
  • Penalty rates (overtime and working on public holidays);
  • Rostering;
  • Team meetings; and
  • Relocation to another Telstra outlet.
    Whilst we have welcomed a number of transferring Vita Group employees to the Union already, we need the support of the majority to deliver the best possible outcome.
