3. DEFINITIONS

3.1 In this award:

3.1.1 Australia Post means the Australian Postal Corporation;

3.1.2 Employee means a person engaged under clause 12 of the Australia Post General Conditions of Employment Award 1999 [Print S0871 [A1686]], unless otherwise provided in this award or another award.

4. DATE THE AWARD STARTS

This award comes into force on and from the beginning of the first pay period to commence on or after 15 November 1999 and shall remain in force for a period of six months.

    5.2 Who the award applies to
    This award applies to all employees employed in classifications listed in Schedule A subject to any limitations or exclusions specified within the award.

    6. RELATIONSHIP WITH OTHER AWARDS AND DETERMINATIONS

    6.1 Relationship with other awards

    6.1.1 Previous Award
    This award supersedes the Australia Post Administrative/Professional (Interim) Award 1995 [Print M9493 [A1687]] but no right, obligation or liability incurred under that award will be affected by such supersession.

    6.1.2 General Conditions
    Employees covered by this award, are covered by all relevant provisions in the Australia Post General Conditions of Employment Award 1999.

    6.2 Inconsistency with Determinations
    This award will be read in conjunction with determinations made from time to time under s.89 of the Australian Postal Corporation Act 1989.

    6.2.1 Where a determination is inconsistent with the provisions of this award, the latter will prevail.

    PART 2 - SALARY RATES

    7. SALARY RATES

    7.1 Classifications and Salary Rates
    The classifications covered by this award and the respective salary rates are specified in Schedule A - Salary rates.

    7.1.2 Where an employee was an Australia Post employee immediately prior to 20 January 2000, that employee may be eligible for a high rate in accordance with Schedule B.

    7.2 Junior Rates
    Subject to any conditions otherwise prescribed, an employee under 21 years of age and who is employed in the classification listed in Table 1 below will be paid an annual salary, calculated to the nearest dollar, by applying the appropriate percentage for the age of the employee as specified in Table 2 below, to the minimum Total Award Rate of an adult employee of the same classification.

    PART 3 - HOURS OF DUTY

    8. HOURS OF DUTY

    8.1 Non-shiftworkers
    The ordinary hours of duty of employees, other than shiftworkers, shall be 36 3/4 hours per week to be worked Monday to Friday within the limits of 8.00am and 6.00pm.

    8.1.1 Reduced Attendances
    Where Australia Post agrees that an employee may work a reduced number of attendances over a cycle of weeks, the hours of duty over those weeks shall average 36 3/4 hours per week.

    8.1.2 Flexible Hours
    The Flexible Working Hours Scheme shall be made available to employees where work routines are not entirely dependent on customer/work flows or operational requirements.
    8.1.2(a) The operation of the Scheme shall take account of the operation and business needs of Australia Post and its employees. These needs will still allow employees to have significant control over their starting and finishing times.
    8.1.2(b) The Flexible Working Hours Scheme will operate consistent with the provisions of this clause, containing arrangements for the standard day, span of hours in accordance with 8.1 above and sub-clause 21.2 of the Australia Post General Conditions of Employment Award 1999 [Print S0871 [A1686]], and including matters dealing with core times, settlement period, flex periods, flex credits and debits, and core time leave.
    8.1.2(c) The times of commencement and cessation of duty, including meal breaks, will be subject to agreement between the manager and the employee. An employee's attendance outside the hours of a standard day but within the span of hours will be subject to the availability of work and the approval of the employee's manager.
    8.1.2(d) Definitions:
    8.1.2(d)(i) Standard day, for the purpose of flextime, is 7 hours and 21 minutes per day;
    8.1.2(d)(ii) Core time means the periods during the day when an employee will perform ordinary duty unless absent on approved leave or core time leave;
    8.1.2(d)(iii) Settlement period means the ordinary working days over which calculations are made to determine flex credit or flex debit carry over;
    8.1.2(d)(iv) Flex period means the periods during the day when an employees hours of duty and times of attendance may be varied;
    8.1.2(d)(v) Flex credit means the accumulated amount of time worked by an employee in excess of the standard days in the settlement period, including any carry over, but does not include time worked as overtime;
    8.1.2(d)(vi) Flex debit means the difference between the sum of the standard days in a settlement period and the aggregate amount of time worked by an employee where the total time worked is less than the sum of the standard days in the settlement period after any necessary adjustment has been made for any absence on approved leave and includes any carry over;
    8.1.2(d)(vii) Core time leave means any approved absence during core time other than approved leave, and may be used for up to a maximum of two full core times during the settlement period.

    8.2 Shiftworkers
    The ordinary hours of duty of employees required to work shift duty shall not exceed 36 3/4 per week or an average of 36 3/4 over a cycle of shifts.

    8.3 Facilitative Provisions
    Hours of duty provisions in this award can be varied in accordance with facilitative provisions contained in clause 21 of the Australia Post General Conditions of Employment Award 1999 [Print S0871 [A1686]].

    (*) Minimum salary payable to an employee with the prescribed educational qualifications or keyboard skills.

    The rates of pay in this award include the arbitrated safety net adjustment payable under the April 1999, May 2000, May 2001 and May 2002 Safety Net Review - Wages decisions [Print R1999, Print S5000, PR002001 and PR002002]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above-award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement is not required.

    Increases made under previous National Wage Case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.

    SCHEDULE B - FORMER PAID RATES AWARD - TRANSITIONAL PROVISIONS

    B.1. EMPLOYEES COVERED BY FORMER PAID RATES AWARD

    B.1.1 The provisions of this Schedule only apply to an Australia Post employee who was employed in Australia Post immediately prior to 20 January 2000 - an "eligible employee".

    B.1.2 The following provisions of this schedule set out the pay rates which applied under the former paid rates award which exceed the award minimum rate in Schedule A and the associated conditions which determined the appropriate pay point for employees. By applying these provisions to eligible employees, the award pay rate which applied to an employee immediately prior to 20 January 2000 can be determined. Where the award salary rate determined in accordance with this Schedule is higher than that otherwise applying under the general award provisions, it will apply to an eligible employee where the rate remains beneficial to the employee.

    B.2 SALARY RATES

    B.2.1 Classifications and Rates of Pay
    All eligible employees performing work within the classifications listed in the following Table, will be paid no less than salary rate or within the range adjacent to the classification.

    B.2.2 No adjustment of Rates
    In accordance with the Paid Rates Decision of 20 October 1998 (Print Q7661), any future increases in salary rates in the award will not apply to the rates in this Schedule.

    B.3 INCREMENTS

    B.3.1 Frequency of Increments
    An employee was, prior to 20 January 2000, entitled to progress one pay point within the pay scale for the employee's classification after twelve months service at a particular pay point. This incremental progression was subject to:

  • the employee demonstrating satisfactory conduct, diligence or efficiency or attendance for duty;
  • any special advancement conditions otherwise prescribed; and
  • the employee not taking leave without pay in excess of one month, unless such leave was deemed to count as service.

    B.3.2 Promotion and Higher Duties Allowance
    B.3.2.1 The salary to be paid to an employee on promotion or transfer is normally the minimum rate for that position except that in circumstances involving overlapping salary ranges, the new salary is normally the next highest salary point in the salary range for the new position.
    B.3.2.2 An employee who was promoted will have included for the purpose of calculating the increment date, any previous period during which the employee acted at the new classification (or a higher classification). This applies whether or not the employee was on higher duties at the new level at the time of promotion provided that:

  • any previous higher level service which is not continuous can only be counted for incremental purposes to the extent that it satisfies the "12 in 24 months, 24 in 48 months, etc principles.

    B.3.3 Deferral of Increments
    B.3.3.1 Where Australia Post is of the opinion that the employee should not immediately receive an increment otherwise payable having regard to the conduct, diligence, efficiency or attendance for duty of the employee, Australia Post may direct that an increment not be paid for a specified period, not exceeding six months.
    B.3.3.2 Where an increment has been deferred, Australia Post may determine that, for the purposes of future advancement, the increment shall be deemed to have been granted from the original date of incremental advancement. Provided that
    where an increment has been deferred owing to misconduct or inefficiency, the provisions of this paragraph shall not apply unless the employee's conduct diligence and efficiency during the ensuing twelve months is reported to be satisfactory.

    B.3.4 Higher Duties Allowance
    B.3.4.1 An employee who had been paid a higher duties allowance was eligible for the same incremental advancement as applied to an employee promoted to the level.
