ALERT: NEW COMCARE COMPLAINTS PROCESS-INFORMATION FOR MEMBERS.

As part of the ongoing changes to the Comcare system a new system of reporting workplace bullying and harassment has been introduced. Under the Occupational Health and Safety Act 1991, employers are responsible for systematically addressing the risks of workplace bullying in their workplace. This includes applying a risk management process to identify and control incidents of workplace bullying.

Employers are responsible for notifying Comcare about workplace bullying incidents.

Remember that workplace bullying creates a risk to health and safety, should be managed the same as any other workplace hazard & is a notifiable incident to Comcare.

As part of the consultation process stakeholder unions have raised concerns that employers have not properly reported all instances of workplace bullying; to overcome this problem Comcare have introduced a direct reporting mechanism for instances of workplace bullying and harassment.

This means:

Employees no longer have to rely on an employer/manager to complete an incident report. Members have indicated in the past that they are not comfortable raising issues of bullying and harassment in the workplace especially if their direct manager is the subject of the complaint

Employees can be assured that accurate information in their own words is provided to Comcare

The complaints process provides the opportunity for information regarding claims handling to be provided to Comcare

Unions can assist members to complete the form

Comcare will have more accurate data on the incidence of bullying and harassment

Unions will have more complete data on compliance with legislation

The forms are available online: or from the Union Office.
