LIST OF CLAIMS FROM FOXTEL SUB CONTRACTORS - SATELLITE

Conditions

1. Routing. There is no coordination from the contractor to the sub-contractors placement of work i.e. At times 2 or more sub- contractors can be within 1 street from each other at the same time and then they have to drive to other locations for their next job.

2. Sub-contractors do not have advanced notice of scheduled work. Sub contractors must be told two days before the work commences and be given one days notice by phone if they have no work. They can't plan out their time because they only find out at 6pm the night before if they have any work.

3. Dirty Ticket of Work. If no one is home or the job cannot proceed for whatever reason the sub-contractors should be paid a $30 fee for the visit. Contractors do not keep track of locations where sub-contractors can't work at the site because of hazards i.e. overreaching tree etc. Therefore sub- contractors keep getting sent to locations where they cannot perform the work. Policy is that the sub-contractors must visit the site to guarantee that the person is not home.

4. Unfair fines for sub-contractors if they lose equipment. At present there is no mechanism for dispute resolution. Any new contract must include a disputes resolution procedure. They must sign a contract that states if a smart card is lost they must pay a $150 fee whereas the customer only pays $50.

5. In any instance where there is a OH&S issue and a second person is required, there should be provisions for a second paid person to assist with job completion. Because time is a big factor for sub-contractors they cut corners on safety i.e. will not wear safety harness as it take too much time to put the harness on and off.

6. FOXTEL needs to address the repercussions of a sub contractor working on/installing PSTN line under the current ACA rules.

7. Where a technician covers a work order and finds extra equipment to be picked, up such as disconnections, they should be paid the going rate (RAS) for each lot of equipment. Sub-contractors are held accountable for the hardware even though they are not paid to do so.

8. Sub-contractors should receive a fee for acting as agents on all collection of FOXTEL's hardware. Contractors would like to remove the financial burden of purchasing and carrying FOXTEL equipment e.g. Dishes and LNBs etc.

9. Anything over a standard two story ladder must be considered a commercial job where the discretion of undertaking the job is upon the sub contractor without prejudice. Flat rate regardless of different working conditions. Rates should vary on type of housing (townhouse, unit or house), commercial or whether a trip on the roof needs to be made etc.

Rates

1. CLR's. If FOXTEL want the sub-contractor to warrant the job for 12 months then CLR must be paid at the going rate for a full install. Without warranty CLRs with existing dish will be paid at a rate of $70 or without dish $85. Unfair responsibilities. If sub-contractors discover unprofessional work from previous installation the sub-contractors are responsible to improve the condition of the work i.e. fix the cabling etc, at their expense.

2. Mobile phone costs average $400. The down time spent on the telephone to FOXTEL must be addressed as this is causing financial and time problems to the sub contractor. Reduce phone contact to FOXTEL if job code changes are necessary Time on the job is wasted by speaking on the phone and waiting for call backs from FOXTEL or contractor. This time lost is not taken into consideration under a flat rate system.

3. Rates are going down against CPI. Cost of running a small business has gone through the roof but rates have fallen. Rates should at least keep up with increases in CPI. Price increases in stock must be passed on to the contractor not the sub contractor.

4. Sub contractors should be paid for the time taken to attend job training and stock take. All costs associated with training should be covered by the contractor. Sub-contractors need to be experts with ADSL and phone line work yet have only undergone inadequate 4hr training which sub-contractors had to pay for.

5. Sub contractors working on Saturdays, Sunday or after 7am to 5pm should be optional and penalty rates should apply. 6. Additional work orders i.e. second outlet or box swap should be paid at primary rate. FOXTEL does not acknowledge cost associated with travel and therefore rates should not be different simply because sub contractor is already on site. Additional work actually cost sub contractor extra in equipment.

7. The rate to install a PSTN return path should be $90 or a standard Telstra fee for service at $22 per 15 minutes.

8. 35% across the board increase in Rates.

9. Payment of $1000 fee offer from FOXTEL

10. Fee Digital FOXTEL installation to sub contractors.

11. Rates to be paid retrospectively to 15 March 2004 following further discussions.

12. Training package for the next 6-8 weeks.

13. File of customer history must be provided to the sub contractor on old work order.

14. If the contractor goes to a computerised system, PDO and trucks will be put in by the contractor not the sub contractor
