3. DEFINITIONS

3.1 Telstra means the Telstra Corporation Limited.

3.2 Union means Community and Public Sector Union.

3.3 GC means the Telstra Corporation General Conditions Award 2001 [AW806392 PR902661]

4. PARTIES BOUND

This award is binding on:

4.1 Telstra in respect of employees who are employed by Telstra in the jobs specified in Clause 8 - Salaries and jobs, Appendix A, B, and C;

4.2 the union and its officers; and

4.3 employees referred to in 4.1.

4.4 Appendix C of this Award will only apply to members of the CPSU who were employed by the Corporation in the International Business Unit (IBU) as at 2 November 1995.

5. OPERATION

5.1 This award replaces and wholly supersedes the Telstra CPSU (Consolidated) Award 1996 [Print N7759 [T1027]]

5.2 This award applies in conjunction with the provisions of the GC. However, to the extent that this award is inconsistent with the GC, this award prevails.

6. DURATION

This award will come into force on and from 28 March 2001 and will remain in force for a period of six months.

7. INCONSISTENCY WITH ACT AND DETERMINATIONS

Where the provisions of this award are inconsistent with the Telstra Corporation Act 1992, as amended from time to time, or any determination made by Telstra then the provisions of this award will prevail.

8. SALARIES AND JOBS

The annual salaries and jobs for employees covered by this award are set out in Appendix A, B and C. The jobs covered by this award are set out below.

9. WORK ORGANISATION

Telstra may direct an employee to carry out such work as is within the limits of the employee's skill and training. Provided that such work is not designed to promote de-skilling and that when employees are required to work at a level above their designated work level, they will be remunerated at the level commensurate with the duties performed. A requirement for supervisors to perform work of employees of a lower classification from time to time as short time relief or temporary support for other employees in appropriate circumstances does not constitute deskilling.

10. PAYMENT OF SALARY

Salary will be expressed as an annual amount but will be paid fortnightly in arrears. Salary and any other associated payments will be deposited into a bank or other recognised financial institution nominated by the employee. Telstra will take all reasonable measures to ensure that the said salaries will be accessible by the employee on the pay day.

11. HOURS OF WORK - OTHER THAN SHIFT WORKERS

11.1 The Flexible Working Hours Scheme (FWHS), unless otherwise provided in this award, will be made available to an administrative and office based employee who is employed in a job specified in Appendix A, in accordance with the FWHS guidelines. For employees working ordinary hours in accordance with the FWHS, the ordinary hours of duty will be 73.5 hours per fortnight.

11.2 Where an employee works ordinary hours in accordance with the FWHS the span of hours for ordinary hours of work will be within the limits of:
11.2.1 7.30 a.m. and 6.00 p.m. Monday to Friday; and
11.2.2 8.00 a.m. and 1.00 p.m. on Saturday.

Provided that if an employee is in a job in Appendix A and does not work ordinary hours in accordance with FWHS the ordinary hours of work will be within the limits of 11.2.

11.3 There can be an extension to the ordinary hours span in 11.2.1 Monday to Friday from 7.00 a.m. and/or up to 7.00 p.m. by local agreement which involves union representatives and in accordance with the process agreed to by Telstra and the union. The maximum daily ordinary hours of work for an employee in these circumstances will be ten hours.

11.4 For an employee not covered by 11.1, the ordinary hours of duty will be 36.75 hours per week or an average of 36.75 per week. The average weekly hours will be worked in one of the following ways:
11.4.1 five days of seven hours 21 minutes per day; or
11.4.2 Where a reduced number of attendances are worked, the ordinary hours of work will not exceed eight hours ten minutes.

11.5 Where an employee works ordinary hours in accordance with 11.4, unless other wise provided, the span of hours for ordinary hours of work will be within the limits of:
11.5.1 6.30 a.m. and 6.30 p.m. Monday to Friday; or
11.5.1 7.30 a.m. and 6.00 p.m. Monday to Friday for an employee employed in a job in Appendix C.

11.6 An employee employed in the job of a Communications Consultant or Manager Grade 1, 2 and 3 will not have a fixed span of hours. However, for the purposes of definition of salary and other conditions such as annual leave, sick leave public holidays, normal hours will be deemed to be seven hours and 21 minutes (i.e. 36.75 hour week).

11.7 Saturday work
11.7.1 An employee who works ordinary hours on Saturday in accordance with 11.2.2 will be paid an additional amount of 40% of salary for all ordinary time worked.
11.7.2 An employee not rostered to work ordinary hours on Saturday will be paid at the normal overtime rate for Saturday work as prescribed by clause 10 - Overtime - of the GC.
11.7.3 Subject to clause 24 - Annual leave - of the GC, the additional payment for ordinary work on a Saturday will be made for any such work which an employee would have performed had they not been on annual leave.
11.7.4 The additional payment prescribed in 11.7.1 will be excluded when calculating overtime or determining any allowance based upon salary. It will also not be paid for any shift work attracting an additional payment.

11.8 Northern Territory

In the application of 11.2 and 11.5.2 to an employee in a job employed in the Northern Territory 6:00 p.m. will be read as 5.30 p.m.

12. SHIFT WORK AND OVERTIME ON SHIFT WORK

12.1 The ordinary hours of work of employees required to work shift will not exceed 36.75 per week or an average of 36.75 over a cycle of shifts.

12.2 For an employee employed in a job in Appendix C and whose work does not permit the working of straight day work as shown in clause 11.4, the hours of work will be an average of 36.75 per week over a cycle of shifts as described in 12.1.1. A reduced number of attendances may be worked in such shifts.

12.2.1 Shift work will be subject to the following conditions:
12.2.1(a) The maximum period of ordinary work on any day, except Saturday, will be nine hours. The minimum period will be seven hours. On Saturdays, the maximum period of ordinary work will be ten hours.
12.2.1(b) The limits of shift work will be:

  • the morning shift will not cease after 6.00 p.m.
  • the afternoon shift will not commence before 1.00 p.m. nor cease after 11.30 p.m.
  • the night shift will not commence before 11.00 p.m. nor cease after 7.30 a.m.
    12.2.1(c) Shifts will be so arranged that, as far as practicable, in every period of two weeks an employee will cease work not later than 1.00 p.m. on one Saturday.
    12.2.1(d) Except in the case of an employee on relief duty, similar commencing and finishing times will be worked on at least three days in each week. An employee on relief work will be employed on day work in accordance with 11.4, when not required for relief work. In this clause the expression "employee on relief work" means an employee rostered for the relief of other employees absent on approved leave or of employees rostered off duty in lieu of Sunday duty.
    12.2.1(e) In exceptional cases the shift duty provisions of 12.2 may be varied by mutual agreement between the parties.

    12.3 Overtime will be payable to a full-time or part-time employee working in accordance with 12.1 and 12.2 for:

    12.3.1 work performed on any day which is beyond the ordinary hours of work for a full-time employee on that day; or

    12.3.2 for a part-time employee work performed in excess of 36.75 hours per week.

    12.4 For overtime worked in accordance with 12.3.1 and 12.3.2 payment will be at the rate of 150% for the first three hours and 200% thereafter Monday to Friday.

    12.5 Work During Meal Breaks

    An employee on shift work may be required to remain in attendance during the meal break subject to the following conditions:

    12.5.1 where the meal break is rostered as time of work no additional payment will be made.

    12.5.2 where the meal break is not rostered as time of work additional payment will be made at the employee's ordinary salary rate for the meal break. Where an employee is required to work during the meal break he/she will be paid at overtime rates for the whole of the meal break.

    12.6 Break Between Shifts

    Where practicable, shifts will be so arranged that there is a minimum break of ten hours, including reasonable travelling time, between the completion of work on one shift and the commencement of work on the next.

    12.7 Notice of Roster Change

    12.7.1 An employee will be given seven days notice of variation to a shift roster. Where seven days notice is not given the employee will be paid at overtime rates (including Higher Duties Allowance) for those hours of the shift that differ from the originally rostered shift. The overtime rates will continue until seven days notice have been given.

    12.7.2 The penalty payment will also apply when the employee is returning to his/her original roster until seven days notice of that change is given, unless the initial change of shift was for a definite limited period notified at that time to the employee.

    12.7.3 Where the shift change is caused by the absence of another employee, of which Telstra did not have seven days notice, three days notice will apply in lieu of the seven days notice provided in 12.7.1.

    12.8 Exchange of Shifts

    12.8.1 Employees will be allowed to exchange shifts, subject to the approval of the manager.

    (Note: Refer also to the provisions of clause 10 - Overtime, clause 11 - Overtime minimum payment, clause 15 - Saturday work - shift workers, clause 14 - Sunday work, clause 17 - Shift work and clause 12 - Payment for public holiday work- of the GC).

    13. MEAL BREAK

    13.1 Employees will have an unpaid meal break after no longer than five hours continuous work. The duration of the break will be one hour but may be less than one hour by agreement between the employee and his/her manager, but no less than 30 minutes.

    13.2 Notwithstanding 13.1 an employee working under the FWHS in accordance with 11.1 will have an unpaid meal break after no longer than five hours continuous work. The meal break will be no less than 30 minutes.

    13.3 Employees, employed in jobs in Appendix C, will have an unpaid meal break after no longer than five hours continuous work. The duration of the break will be one hour but may be less then one hour, but may be no less than 30 minutes. Changes to meal breaks will be made by mutual agreement between the majority of employees in a work group and the manager.

    14. OVERTIME

    14.1 Telstra may require an employee to work reasonable overtime.

    14.2 Where an employee works ordinary hours in accordance with the FWHS as prescribed in Clause 11.2 overtime is paid for work performed:
    14.2.1 Before 7.30 a.m. and/or after 6.00 p.m. Monday to Friday
    14.2.2 Before 8.00 a.m. and/or after 1.00 p.m. on Saturday
    14.2.3 Between 7.30 a.m. and the normal commencing time on any day, Monday to Friday, where the employee performs duty after 6.00 p.m. on that day.

    14.3 Where an employee works ordinary hours in accordance with the FWHS as prescribed in 11.3 overtime is payable for work performed:
    14.3.1 Before the agreed commencing time and/or after the agreed finishing time.
    14.3.2 Before 8.00 a.m. and/or after 1.00 p.m. on Saturday.
    14.3.3 Between the agreed commencing time and the normal commencing time on any day, Monday to Friday, where the employee performs work prior to the agreed span commencing time and also completes a normal day's work on that day.
    14.3.4 For the period up to the agreed span finishing time after the completion of a normal day's work on any day, Monday to Friday, where the employee performs work after the agreed span finishing time on that day.
    14.3.5 In excess of the ten hour maximum daily ordinary hours.

    14.4 Overtime is payable where an employee is directed to work overtime within the ordinary hours bandwidth and this period when added to other hours worked within the fortnight exceeds 73.5 hours (excluding overtime work specified in 14.2 and 14.3 and flextime credits). The period taken as overtime cannot be counted as flex credit.

    14.5 Where an employee works his/her ordinary hours in accordance with 11.4 overtime is payable for:
    14.5.1 work performed on any day which is beyond the ordinary hours of work for a full time employee on that day; or
    14.5.2 work performed on any day outside the span of ordinary hours.

    14.6 For overtime worked in accordance with 14.2, 14.3 and 14.4 payment will be made at the rate of 150% for the first three hours and 200% thereafter for all overtime worked Monday to Saturday.

    14.7 Rest relief after overtime

    14.7.1 An employee will have at least ten consecutive hours off work (inclusive of reasonable travelling time) between periods of ordinary hours of work.

    14.7.2 Where an employee works overtime between periods of ordinary hours of work he/she will have ten consecutive hours off work between these times before commencing his/her next period of ordinary hours of work, without loss of pay.

    14.7.3 If an employee is required to resume or continue work without ten consecutive hours off work he/she will be paid at 200% until he/she ceases that period of work and will then be eligible to be absent from work until the employee has had ten consecutive hours off work without loss of pay for ordinary hours work scheduled during that absence.

    14.7.4 The provisions of 14.7.1, 14.7.2 and 14.7.3 will not apply to overtime worked in emergency situations covered by clause 18 - Emergency work - of the GC unless the actual time worked is at least three hours on each attendance.

    14.7.5 The provisions of 14.7.1, 14.7.2 and 14.7.3 will not apply to overtime worked immediately prior to the commencement of ordinary hours of work, unless the overtime work is of at least three hours duration.

    14.8 Overtime payments - part time employees

    A regular part time employee will be paid overtime in accordance with 14.6 when he/she works:

    14.8.1 Outside the span of ordinary hours; or

    14.8.2 Outside the regularly rostered daily hours of an equivalent full time employee; or

    14.8.3 Work other than specified in clauses 14.8.1 and 14.8.2 performed in excess of 36.75 hours per week or an average of 36.75 hours per week

    14.9 Special payments - overtime

    An employee, who is employed in a job in Appendix C and is required to work overtime between the hours of 11.00 p.m. and 7.00 a.m. will be paid at the rate of 200%.

    (Note: Refer also to the provisions of clause 10 - Overtime, clause 11 - Overtime minimum payment, clause 12 - Payment for public holiday work and clause 14 - Sunday work - of the GC).

    15. ALLOWANCES

    15.1 Wearing of Breathing Apparatus Allowance

    An employee who is required to work in areas where asbestos is evident will wear respiratory protective equipment supplied by the Company. The respiratory equipment will conform, where relevant, to the Australian Standard 1716 (Specification for Respiratory Devices).The employee will be paid a breathing apparatus allowance at the rate shown in Item 1 of Appendix D of $1.38 for each hour worked in such an area.

    15.2 Office Renovation Allowance

    15.2.1 Where an employee is required to perform work in an existing building undergoing major structural or internal alterations and encounters a significant disability caused by the alterations for two hours or more on a shift, the employee will be paid an allowance as specified in Item 2 of Appendix D.

    15.2.2 For the purpose of this clause, a significant disability occurs when an employee encounters noise, dust, equipment (such as ladders, power cords) and activities which create disturbance.

    15.3 Country Employees Meal Allowance

    15.3.1 An allowance shown as Item 3 of Appendix D will be paid to an employee at a country station when he/she is away from his/her usual workplace during the midday meal hour, providing that the employee normally returns to his/her home for their midday meal and the manager certifies that the employee was sent away from the usual workplace without notice being given before the employee left home, and without an opportunity of visiting home and arranging for a meal and that the employee was not within 6.4 kilometres of the workplace between the hours of l2.00 p.m. and 2.00 p.m.

    15.3.2 An employee will be paid the allowance as provided in Clause 15.3.1 where an employee is required on any day or part thereof to work in snow at least 10 cm deep.

    15.3.3 Where an employee is eligible for an allowance as specified in 15.3.1 and 15.3.2:
    15.3.3(a) an employee will only be eligible to claim payment for one country employees meal allowance per day;
    15.3.3(b) an employee receiving travelling allowance will not be eligible to claim payment for country employees meal allowance;
    15.3.3(c) in addition, an employee will be subject to the provisions of clause 20 - Meal allowance - of the GC.

    15.4 Height Allowance

    An employee required to carry out work on a tower, mast, guy-rope and all telecommunications structures on the external faces of buildings and parapets, at a height of at least 15 metres for a minimum of two hours in any day, shall be paid a height allowance at the rate shown in Item 4 of Appendix D.

    15.5 Linguistic Availability Performance Allowance

    A employee who is directed to perform, in addition to their other work, work which consists of:

    15.5.1 translating speech or written material from one language to another; or

    15.5.2 communicating information to a disabled person by means of signs, and translating signs made by a disabled person; will be paid an allowance, while the direction remains in force, a linguistic allowance as shown at Item 5 of Appendix D.

    16. RELATIONSHIP TO NATIONAL TRAINING WAGE AWARD 2000

    16.1 The parties to this Award will comply with the terms of the National Training Wage Award 2000 [Print T0813 [N0277]], as varied, as though bound by clause 4 of that Award.

    16.2 The terms of the National Training Wage Award 2000, as varied, will apply to employment under this Award so as to override the salaries in Appendix A, B and C of this award in the manner specified in clause 5 of the National Training Wage Award 2000, as varied.

    17. NOTICE BOARDS

    Telstra will permit access to or the erection of notice boards to facilitate communication between employees and union representatives.

    18. SAVINGS

    Nothing in this award will operate to reduce the rate of pay or conditions of employment of an employee which were in existence immediately prior to or at the commencement of this award except where this award adopts the conditions of employment contained in the Telstra Corporation General Conditions Award 2001 as varied from time to time.

    19. PROCEDURE TO RESOLVE GRIEVANCES AND AVOID INDUSTRIAL DISPUTATION

    [19 Procedure to avoid industrial disputation title changed and substituted by PR937397 from 04Sep03] 19.1 The primary responsibility for dispute resolution is between employee/s and their managers/supervisors. In the event of a dispute or grievance arising in the workplace, about matters arising under this award, either on an individual or collective basis, the procedure to be followed to resolve the matter will be:

    19.1.1 The employee/s and their managers/supervisors will meet and confer on the matter.

    19.1.2 If the matter is not resolved at that meeting, the parties will arrange for further discussions between the employee/s and more senior levels of management. The employee/s may have a representative. The representative may participate fully but not answer questions on behalf of the person/s raising the grievance or dispute. Where the representative is also an employee of the employer, both persons shall have a reasonable amount of paid time off work to prepare for the meeting.

    19.1.3 If the matter is still not resolved, the employee/s, or their representative, will elevate it to the head of the Business Unit with written advice to Human Resources . At the election of the person raising the grievance, she/he shall be entitled to representation in the manner described in 19.1.2.

    19.1.4 If the matter is still not resolved it may be referred to the Australian Industrial Relations Commission. Where a representative from the workplace has been involved and that person is requested to continue to be the sole representative, then the representative and the person involved in the grievance shall be granted time off work without loss of pay for the purpose of attending the hearing only.

    19.2 To assist in the resolution of disputes, a representative referred to in this clause, will be granted leave of absence of up to a total of three days to attend short courses which are specifically directed towards effective dispute resolution. The grant of leave will be subject to the following conditions:

    19.2.1 Each year the relevant business unit manager, following consultation with CPSU, shall decide how many employee representatives will attend dispute resolution training in the following twelve months having regard to the:
    19.2.1(a) size and geographical location of the place of work;
    19.2.1(b) number of employee representatives at each location;
    19.2.1(c) operational requirements of each geographic location as it relates to any foreseen peak periods;
    19.2.1(d) number of representatives that have received training, those that need to be trained, and the issues upon which training has taken place;
    19.2.1(e) incidence and location of grievances; and
    19.2.1(f) views of employee representatives.

    19.2.2 In any given year a decision made under clause 19.2.1 should normally be made no later than the end of February, but this does not limit the discretion of the relevant business unit manager should circumstances arise where those circumstances bear upon the application of factors set out in clause 19.2.1.

    19.2.3 Decisions under clause 19.2.1 may be made at the initiative of the relevant business unit manager or following requests made by CPSU.

    19.2.4 An employee representative will give the relevant one-up manager of the employer, a minimum of five weeks notice of the employee representative's intention to attend the course. Less notice may be provided by agreement between the employee representative and the relevant one-up manager.

    19.2.5 The notice to the relevant one-up manager will outline the type, content, duration and dates of the course to be attended.

    19.2.6 The grant of leave will be provided by the employer subject to the operating requirements of the business.

    19.2.7 The employee representative granted the leave will be paid all ordinary time earnings which would normally apply during the leave. Only an employee who has completed 12 months continuous service with Telstra or a related company shall be eligible for such leave.

    19.2.8 All expenses associated with, or incurred by, the employee representative granted the leave will not be the responsibility of the employer.

    19.2.9 Leave of absence taken pursuant to this clause will count as service for all purposes.

    19.2.10 The employee representative granted the leave will provide proof of attendance at the course to the satisfaction of the employer.

    19.2.11 For the purposes of this clause, employee representative may be a union delegate, a union deputy delegate, or employee representative who is duly appointed or elected by employees in a workplace.

    19.2.12 For the purpose of this clause a business unit manager shall be the manager of that part of the business covered by an agreement certified under the Workplace Relations Act 1996 or that person's nominee.

    19.2.13 A dispute in relation to the granting of, or refusal to grant, leave under this clause shall be dealt with in accordance with clause 19.1 of this award.

    20. DISCLOSURE OF QUALIFICATIONS

    An employee whose salary and/or classification is determined by reference to the employee's qualifications will, if required by Telstra, provide verification of that qualification.

    21. EXEMPTIONS

    21.1 Except with a manager's approval, the occupants of Professional positions or Information Technologist positions the minimum salary of which exceeds, respectively:

  • the maximum salary of a Professional 2;
  • the maximum salary of an Information Technologist Grade 3;or
  • the maximum salary of a Principle Technical Officer Grade 2;
    will not be eligible to receive any overtime payment under clause 14 of this award or clause 10- Overtime, GC; clause 11 - Overtime - minimum payment GC; clause 19 - Excess travelling time; clause 12 - Public holidays, GC; and clause 22 - Essential customer servicing allowance, GC.

    21.2 For the purposes of clause 21.1 the award salary of the Professional 2, Information Technologist Grade 3 and the Principle Technical Officer Grade 2 will be adjusted on 1 July of each year following the most recent Safety Net Adjustment decisions (or such like) of the Australian Industrial Relations Commission.

    22. SAFETY NET

    The salaries in this award include the arbitrated safety net adjustment payable under the Safety Net Review - Wages May 2004 decision [PR002004]. This arbitrated safety net adjustment may be offset against any equivalent amount in rates of pay received by employees whose wages and conditions of employment are regulated by this award which are above the wage rates prescribed in the award. Such above award payments include wages payable pursuant to certified agreements, currently operating enterprise flexibility agreements, Australian workplace agreements, award variations to give effect to enterprise agreements and overaward arrangements. Absorption which is contrary to the terms of an agreement is not required.

    Increases made under previous National Wage Case principles or under the current Statement of Principles, excepting those resulting from enterprise agreements, are not to be used to offset arbitrated safety net adjustments.

    1.1 An employee employed in the job of Professional Level 1 will be paid a salary shown at note (a) where the employee has:
  • a degree or equivalent; or
  • a degree/diploma of Social Studies or
  • a degree and completion of the Registration Examination of the Library Association of Australia.

    1.2 A professional employee employed in the job of a Professional Level 1 will be paid a salary shown at note (b) where the employee has:

  • an honours degree and completion of the Registration Examination of the Library Association of Australia, or equivalent; or
  • a 4/5-year honours degree or equivalent.

    1.3 A salary shown at note (c) will be payable to a Professional 1 (Engineering Graduate). A salary shown at note (d) will be payable to a Professional 1 (Experienced Engineer).
    1.3.1 Professional Engineering work will mean the work carried out by an employee in any particular employment the adequate discharge of any portion of which requires qualifications as (or at least equal to those of) a graduate member of the Institution of Engineers, Australia.
    1.3.2 Professional Engineer will mean an employee qualified to carry out professional engineering work as defined in clause 1.3.1. The term "professional engineer" embraces and includes the term "graduate engineer" and "experienced engineer" as defined in clauses 13.3 and 1.3.4.
    1.3.3 Graduate engineer will mean a professional engineer who is the holder of a university degree (four or five year course) recognised by the Institution of Engineers, Australia, or is the holder of an appropriate degree, diploma or other testamur.
    1.3.4 Experienced Engineer will mean a professional engineer who is eligible to be a member of the Institution of Engineers, Australia or has four years experience on professional engineering work since becoming a graduate engineer.

    2. SALARIES - JUNIOR EMPLOYEES

    An employee under 21 years of age employed as an Administrative Officer 1, will be paid a salary calculated as a percentage of the salary rate for the equivalent adult job as shown below.
