AT813059 - TELSTRA (REMOTE LOCALITY) AWARD 2002



1. SCOPE

1.1 This award shall apply to any person:
1.1.1 employed by Telstra Corporation Limited (Telstra);
1.1.2 whose employment is governed by the Telstra Corporation General Conditions of Employment Award 2001 [AW806392]; and / or
1.1.3 who, by virtue of either having their work base in, or predominantly performing work in, a remote locality before the operative date of this award received an allowance, entitlement or benefit, immediately prior to the operative date of this award, or would be entitled to receive an allowance, entitlement or benefit;
but shall not apply to:
1.1.4 any person who works in a Locality which has been declassified pursuant to clause 7 of this award; or
1.1.5 any employee whose employment is covered by the Telstra Retail Shops Agreement 1998 [AG800757]; or
1.1.6 any employee who is bound by an AWA whose rights are not affected by this award.

1.2 A person covered by this award shall be known as an Employee.

2. PARTIES BOUND

2.1 This award is binding on:
2.1.1 Telstra;
2.1.2 the following unions:
2.1.2(i) Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU);
2.1.2(ii) the Community and Public Sector Union [CPSU];
2.1.2(iii) The Association of Professional Engineers, Scientists and Managers, Australia [APESMA];
2.1.3 an Employee who is a member of one of the unions referred to in 2.1.2; and
2.1.4 an Employee who is eligible to be a member of one of the unions referred to in 2.1.2.

3. DATE OF OPERATION

This award shall commence on 15 January 2002 and remain in force for a period of six months.

4. EXISTING ALLOWANCES

Subject to the terms of this award, any allowance, entitlement or benefit received by an Employee immediately prior to the operative date of this award by virtue of them working in a Locality shall continue to apply.

5. DISTRICT ALLOWANCE

5.1 An Employee is entitled to a District Allowance determined and paid in accordance with this award.

5.2 For the avoidance of doubt, a District Allowance is not payable to an Employee whose work base is in, or who performs work predominantly in, Darwin, Townsville or Cairns.

6. COMPONENTS OF THE DISTRICT ALLOWANCE

The District Allowance shall comprise of:

6.1 for an Employee with dependents, an annual payment calculated on the following basis:
Grade 1 $6,240
Grade 2 67.95% of the Grade 1 amount;
Grade 3 50.16% of the Grade 1 amount;
Grade 4 20.53% of the Grade 1 amount.

The annual payment for Grade 1 shall be adjusted by Telstra on 1 July of each year in accordance with the Consumer Price Index

6.2 for an employee without dependants, an annual payment calculated on the following basis:
Grade 1 61.85% of the Grade 1 amount specified in clause 6.1
Grade 2 38.62% of the Grade 1 amount specified in clause 6.1
Grade 3 27.40% of the Grade 1 amount specified in clause 6.1
Grade 4 11.00% of the Grade 1 amount specified in clause 6.1

6.3 additional annual leave calculated on the following basis:
Grade 1 7 x days
Grade 2 5 x days
Grade 3 3 x days
Grade 4 2 x days

6.4 Payment of airfares and other subsidies.

Each employee shall continue to be paid or provided the same value airfares and subsidies which were paid or provided by Telstra immediately prior to the operative date of this award, except that the airfares and subsidies will be paid as an annual payment.

7. VARIATIONS TO LOCALITY OR GRADE

7.1 Telstra may, reclassify or declassify a locality subject to clauses 7.2 and 7.3 of this award. Immediately upon and following declassification of a Locality, an Employee who works in the Locality shall not be entitled to a District Allowance or any allowance, entitlement or benefit received by an Employee immediately prior to the declassification by virtue of them working in a Locality.

7.2 Telstra shall advise the other respondents to this award prior to reclassifying or declassifying a Locality. The notification shall, consistent with clause 7.4 specify the basis for the proposed reclassification or declassification, and be accompanied by documents that support the proposed reclassification or declassification.

7.3 A union respondent shall advise the other respondents of this award of any demand for reclassification or declassification of a Locality. The notification shall, consistent with clause 7.4, specify the basis for the proposed reclassification or declassification and be accompanied by documents that support the proposed reclassification or declassification.

7.4 Any reclassification or declassification of a Locality shall be determined having regard to:

7.4.1 the isolation of the Locality, including but not limited to:
7.4.1(i) its distance from the nearest capital city; access to and from the Locality by road, rail and air;
7.4.1(ii) the ease of access to, and cost of, amenities within the Locality, including electricity, gas, water, schooling, transport and food.

7.4.2 the climate of the Locality, as determined by the Bureau of Metrology;

7.4.3 the cost of living of the Locality when compared to the average cost of living in Australia;

7.4.5 the population size of the Locality.
