TELSTRA / MEAA AWARD 2003



1. TITLE

This Award shall be known as the Telstra/MEAA Award 2003.

2. ARRANGEMENT

(see index)

3. DEFINITIONS

In this award:

3.1 Corporation means the Telstra Corporation Limited.

3.2 Determination means a determination made pursuant to the General Power of Attorney of the Australian and Overseas Telecommunications Corporation Limited dated 31 January 1992 and successors.

4. PARTIES BOUND

This award shall apply to:

4.1 The Media, Entertainment and Arts Alliance, its officers and members, being the claimant organisation; and

4.2 The Corporation in respect of employees occupying the positions referred to in clause 8 - Duties, responsibilities, qualification and experience, whether members of the claimant organisation or not.

5. DURATION

This award shall come into operation on 1 April 2003 and shall remain in force for a period of 12 months.

6. INCONSISTENCY WITH ACTS AND DETERMINATIONS

6.1 This award shall be read in conjunction with the Telstra Corporation Act 1992 and any Determinations and successors.

6.2 Where the said Act and Determinations are inconsistent with the provisions of this award the latter shall prevail.

7. RELATIONSHIP WITH OTHER AWARDS

This award shall supersede the AOTC/MEAA Award 1993 [Print E4718 [AW765829]] but no rights, obligations or liabilities incurred or accrued under any such award will be affected by such supersession with respect to allowable award matters only.

9. WORK ORGANISATION

An employee may be directed to carry out such duties which are within the relevant position classification standards of the corporation and are within the limits of the employee's skill, competence and training. Provided that such duties are not designed to promote deskilling and that employees are required to work at a level above their designated work level, they will be remunerated at the level commensurate with the duties performed.

10. DUTIES, RESPONSIBILITIES, QUALIFICATIONS AND EXPERIENCE

10.1 Duties and responsibilities

10.1.1 Media relations officer/Senior media relations officer
10.1.1(a) Represent Telstra, its subsidiary companies and partners to media and principal media people throughout Australia and where appropriate, overseas;
10.1.1(b) prepare and review, in line with Telstra's corporate objectives and policies, media strategies and implementation plans and measurement techniques to assess their effectiveness;
10.1.1(c) provide high level advice to senior management in the corporate centre, divisions, regions, districts and shared resource units on issues which expose/could expose Telstra to media interest within Australia and overseas;
10.1.1(d) develop and implement action plans for media coverage of Telstra decisions and policies, addressing key target audiences and through identified target media;
10.1.1(e) monitor media issues which impact/could impact upon Telstra and provide timely, accurate and researched briefings to management. Initiate positive Telstra responses to these issues;
10.1.1(f) develop media releases from key speeches, policies, decisions, launches and other activities which will promote positive perceptions and create understanding of Telstra's role, goals and objectives;
10.1.1(g) maintain a wide range of media contacts and enhance their understanding of Telstra activities, policies and corporate objectives, maintain up to date media contact lists;
10.1.1(h) prepare speeches for senior Telstra personnel and the National Communications Team highlighting the key communications messages and objectives;
10.1.1(i) organise and promote the availability of appropriate Telstra personnel as media spokespeople;
10.1.1(j) implement response programme to criticism of Telstra in the media;
10.1.1(k) organise and participate in training of key Telstra personnel to be effective spokespeople in the media;
10.1.1(l) maintain strong working relationships with all areas within Telstra and, through coordination with other corporate communications functions and with business units, provide effective issues management;
10.1.1(m) provide high standard journalistic input to Telstra publications and electronic productions;
10.1.1(n) brief photographers and camera operators to maximise pictorial support for journalistic activities.

10.1.2 Publicity photographer (Telstra)
10.1.2(a) Plan and supply high quality photography for corporate publications and productions, and major promotion and publicity activities;
10.1.2(b) identify photographic opportunities which enhance the promotion of Telstra's communications policy, objectives and key messages in the media, at public events and in material distributed to the public;
10.1.2(c) raise and maintain consciousness within Telstra's of the benefits of high quality photographic support to Telstra's communications objectives;
10.1.2(d) maintain an up to date knowledge of developments in photographic styles, processing and printing techniques, equipment and audio visual aids;
10.1.2(e) advise management of the most effective means of utilising photographic opportunities and skills for maximum audience impact;
10.1.2(f) perform film processing;
10.1.2(g) provide captions for photographs for publication;
10.1.2(h) maintain a pictorial library for current and historical purposes.

10.2 Qualifications and experience
10.2.1 Media relations officer (below the barrier)
10.2.1(a) Journalistic experience in the media at a graded level;
10.2.1(b) knowledge of various forms of media, their requirements and operating methods;
10.2.1(c) excellent communications skills;
10.2.1(d) ability, or capability with training, to use electronic methods of communications to enhance information flows within Telstra, to media and other targeted audiences.

10.2.2 Media relations officer (above the barrier)
10.2.2(a) Enhance knowledge, skill and experience in areas identified for entry levels;
10.2.2(b) develop a detailed understanding of Telstra corporate objectives, and the reasons for them;
10.2.2(c) extensive personal contacts within the media and ability to develop effective working relationships with Telstra management;
10.2.2(d) proven ability to perform duties and meet responsibilities identified as core activities of the media relations section;
10.2.2(e) positions at the highest salary point of the salary range will carry responsibility for local budgeting, local media strategies and plans, staff management and staff development.

10.2.3 Senior media relations officer

In addition to requirements for a Media relations officer:

10.2.3(a) Proven abilities to establish, maintain and further develop beneficial relationships with senior executives of Australia's most influential media, and media which reach the larger segments of Telstra's audiences;

10.2.3(b) positions at these levels would, in all probability, be located in Telstra's corporate centre, and New South Wales and Victorian administrations.

10.2.4 Publicity photographer (Telstra)
10.2.4(a) Proven photographic skills of a high order;
10.2.4(b) extensive experience as a print media and/or publicity photographer;
10.2.4(c) ability to provide high standard photographs while working to tight deadlines;
10.2.4(d) detailed understanding of the photographic format requirements of various media types, displays, magazines and brochures;
10.2.4(e) ability to write appropriate captions for photographs to be used for publication.

11. GENERAL CONDITIONS OF EMPLOYMENT

Employees shall be subject to the provisions of the following clauses of the Telstra Corporation General Conditions Award 2001 as varied from time to time:

12. HOURS OF DUTY AND OVERTIME

12.1 The ordinary hours of duty shall be 36-3/4 per week, within the limits of 8.00 a.m. and 6.00 p.m. Monday to Friday, as may be determined by the Corporation.

12.2 Any employee shall be liable to be called for duty any time that they are required, subject to payment for overtime under the conditions set out in this clause.

12.3 Overtime shall be payable:

12.3.1 for duty performed before 8.00 a.m. and/or after 6.00 p.m., Monday to Friday;

12.3.2 for duty performed between 8.00 a.m. and the normal commencing time on any day, Monday to Friday, where the employee performs duty prior to 8.00 a.m. and also completes a normal day's duty, on that day;

12.3.3 for duty performed between 8.00 a.m. and 6.00 p.m. after the completion by the employee of a normal day's duty on any day, Monday to Friday, where the officer performs duty after 6.00 p.m. on that day.

12.3.4 for duty (other than duty specified in 12.2) performed in excess of 38 hours per week within the limits of 8.00 a.m. and 6.00 p.m., Monday to Friday;

12.3.5 for duty on Saturday.

12.4 Payment shall be made at the rate of time and a half for overtime worked Monday to Friday, and at the rate of time and a half for the first three hours and double time thereafter for overtime worked on Saturday, subject to the conditions prescribed in clause 10 - Overtime of the Telstra Corporation General Conditions Award 2001 as may be varied from time to time.

For the purpose of 10.4 of the Telstra Corporation General Conditions Award 2001, as may be varied from time to time, the prescribed weekly hours before overtime is payable shall be 38.

12.5 The provisions of this clause relating to overtime payment shall apply only to employees whose ordinary hours of duty conform to those prescribed in 12.3.3 or the equivalent as worked in a five day week pursuant to clause 9 - Five day working week of the Telstra Corporation General Conditions Award 2001, as may be varied from time to time.

13. ENTERPRISE FLEXIBILITY PROVISIONS

(See ss.113A and 113B of the Act)

Where an employer or employees wish to pursue an agreement at the enterprise or workplace about how the award should be varied so as to make the enterprise or workplace operate more efficiently according to its particular needs the following process shall apply:

13.1 A consultative mechanism and procedures appropriate to the size, structure and needs of the enterprise or workplace shall be established.

13.2 For the purpose of the consultative process the employees may nominate the Union or another to represent them.

13.3 Where agreement is reached an application shall be made to the Commission.

14. ANTI-DISCRIMINATION

14.1 It is the intention of the respondents to this award to achieve the principal object in s.3(j) of the Workplace Relations Act 1996 through respecting and valuing the diversity of the work force by helping to prevent and eliminate discrimination on the basis of race, colour, sex, sexual preference, age, physical or mental disability, marital status, family responsibilities, pregnancy, religion, political opinion, national extraction or social origin.

14.2 Accordingly, in fulfilling their obligations under the dispute avoidance and settling clause, the respondents must make every endeavour to ensure that neither the award provisions nor their operation are directly or indirectly discriminatory in their effects.

14.3 Nothing in this clause is taken to affect:

14.3.1 any different treatment (or treatment having different effects) which is specifically exempted under the Commonwealth anti-discrimination legislation;

143.2 junior rates of pay;

14.3.3 an employee, employer or registered organisation, pursuing matters of discrimination in any State or federal jurisdiction, including by application to the Human Rights and Equal Opportunity Commission;

14.3.4 the exemptions in s.170CK(3) and (4) of the Act.
