TELSTRA EBA OVERVIEW



TELSTRA EBA POSITION

20 JUNE 2021



As of 20 June 2021, Telstra Corporation is a large employer with a number of small subsidiaries, including Telstra Purple.

The plan is to break up Telstra into four major subsidiaries:
- InfraCo Fixed
- InfraCo Towers
- ServeCo
- International

The BUD (Break Up Day) is expected to be in late December 2021.

Award Position

Modern Awards set minimum conditions and are used as the basis of the Better Off Overall Test (BOOT).

Telstra is also bound by the enterprise "Telstra Award", while the general Telecommunications industry is covered by the Telecommunications Services Award. The Telstra Award is far superior to the Industry Award.

EBA Position

Generally Speaking EBAs have better terms and conditions compared to the Award and override the Award.

Telstra is covered by an EBA which expires on 30 Sept 2021. However an EBA will remain in force after the nominal expiry date until replaced. It covers almost all staff. Telstra Purple was recently covered by its own EBA. It is significantly inferior to the Telstra EBA.

BUD Day Transition

These comments are based on what we have been told to date. Events may change.

ServeCo

ServeCo is just the existing Telstra Corporation which has been renamed.. It will continue to be bound by the Telstra Award and the current EBA. Negotiations for a new EBA are to take place prior to BUD. A new EBA may be in place by BUD.

Telstra Group

Telstra Group is a new legal entity. It may only have a small number of workers. Initially, it will be bound by the inferior "Telecommunications Services Award". It will have no EBA.

However our Union must insist that it apply to become bound by the "Telstra Award". Further, we need an EBA to cover employees. Telstra is seeking a separate EBA for each subsidiary. Our Union is seeking one EBA to cover all subsidiaries.

Negotiations are to commence soon.

InfraCo Fixed

InfraCo Fixed is a new legal entity. Initially, it will be bound by the inferior "Telecommunications Services Award". It will have no EBA.

However our Union must insist that it apply to become bound by the "Telstra Award". Further, we need an EBA to cover employees. Telstra is seeking a separate EBA for each subsidiary. Our Union is seeking one EBA to cover all subsidiaries.

InfraCo Towers

InfraCo Towers is a new legal entity. Initially, it will be bound by the inferior "Telecommunications Services Award". It will have no EBA.

Telstra Purple

Telstra Purple is bound by the inferior Telecommunications Services Award. It already has a recently approved EBA.
