Optus EA: CWU and Optus consider rules of engagement

The CWU has been in discussions with Optus preliminary to the formal start of enterprise negotiations.

The discussions have largely focussed on the way the negotiations will be handled and the general expectations of the parties rather than on the actual content of a new agreement. However, the CWU has indicated a number of broad issues which it wants considered in negotiations including redundancy conditions, delegates training and rights and, of course, wage increases.

Optus has indicated that its preferred approach to the next agreement is one which would see minimal change to current conditions. The CWU has replied that while it acknowledges this is Optus' objective it will not itself be limited by it in bargaining.

The CWU is also keen to see that any communications to staff about the bargaining process explain employee rights clearly i.e.

  • All employees are entitled to representation in bargaining.
  • CWU members are automatically represented by the CWU unless they specifically decide otherwise. There is no need for members to actually nominate the CWU as their representative.
  • Non-CWU members wanting to appoint a bargaining representative must specifically nominate such a person.

    The CWU is continuing discussions with Optus about these procedural matters as well as about a timetable for negotiations. A communication to staff from the company is expected in the next few days.

    Optus prepares for bargaining

    Optus is preparing for the coming round of collective bargaining and has asked the CWU to identify the issues we want to deal with in the negotiations for a new Enterprise Agreement.

    The current Optus Enterprise Agreement (or Employee Partnership Agreement as it is called) reaches its nominal expiry date in mid-October.

    Optus has not yet formally notified employees that it wishes to bargain as it is required to do under current legislation but it has started putting the framework for this bargaining in place. It has also indicated that its preferred approach would see minimal changes to the current EPA.

    All Optus employees need to be clear about their role and their rights in this process.

  • All employees have a right to representation in bargaining.
  • If you are a CWU member you are automatically represented by the union unless you choose otherwise.
  • If you are not a CWU member and wish to nominate a bargaining representative you must do so in writing.

    The current workplace laws require Optus to inform employees about these rights when bargaining is initiated.

    In the meantime, the CWU wants to hear from Optus members about issues they want addressed in the coming EA negotiations. Contact your state branch now to have input into the bargaining process.
